Trackbie Terms and Conditions

Please read these Terms and Conditions ("Terms," "Terms of Service") carefully before downloading, installing, accessing, or using the Trackbie mobile application and website.

1. Acceptance of Terms

These Terms govern your access to and use of the Trackbie mobile application, website, and related services (collectively, the "Application" or the "Service"), operated by Trackbie ("Service Provider," "we," "us," or "our").

By downloading, installing, registering, or using Trackbie, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our incorporated Privacy Policy. If you do not agree to these Terms, you must not download, install, or use the Application.

2. Eligibility and Age Requirement

You must be at least 18 years old to use the Application. By creating an account or using the Service, you represent and warrant that:

• You are at least 18 years of age;
• You are legally capable of entering into a binding agreement in your jurisdiction; and
• Your use of the Application does not violate any applicable law or regulation.

The Application is not intended for use by minors. If we learn that an account belongs to anyone under 18, we reserve the right to immediately terminate the account and delete associated data without prior notice.

3. Account Registration & Security

To access certain features of Trackbie, you must register for an account. User authentication is managed securely via Supabase (supporting Email/Password credentials, Google Sign-In, and Apple Authentication).

• Credential Confidentiality: You are solely responsible for maintaining the confidentiality of your account credentials, login tokens, and connected SSO accounts.
• Account Activity: You are fully responsible for all activities, actions, and uploads that occur under your account credentials.
• Unauthorized Access: You agree to notify us immediately at sachinmehroliya13713@gmail.com if you suspect or become aware of any security breach or unauthorized access to your account.

4. Acceptable Use Policy

You agree to use the Application solely for lawful purposes and in accordance with these Terms. You explicitly agree NOT to:

• Misuse the app or interfere with its operational integrity, servers, or networks;
• Attempt unauthorized access to any accounts, computer systems, or infrastructure connected to Trackbie;
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code or underlying AI prompts/algorithms of the Application;
• Scrape, mine, or extract data from the Application using automated devices, bots, or scripts;
• Upload, post, or transmit any illegal, harmful, threatening, defamatory, obscene, invasive of privacy, or infringing content;
• Upload photographs of identifiable third parties without their explicit consent;
• Use the Application for any commercial, illegal, or competitive benchmarking purpose without our prior written authorization.

5. Analytics & Service Monitoring (PostHog Integration)

To ensure app stability, optimize performance, and improve user experience, Trackbie integrates telemetry and product analytics services (including PostHog via posthog-react-native and posthog-react-native-session-replay).

• Consent to Telemetry: By using the Application, you acknowledge and consent to our collection and processing of diagnostic telemetry, crash reports, performance metrics, and masked visual session replays as detailed in our Privacy Policy.
• Data Protection: All sensitive text input fields (such as passwords, auth tokens, and health details) are automatically masked during session replays.
• Opt-Out Rights: You may opt out of non-essential analytics tracking via in-app settings or by contacting customer support.

6. Intellectual Property Rights

All rights, title, and interest in and to the Application — including but not limited to its software code, UI design, graphics, branding, trademarks, logos, AI workflows, and content (excluding your personal User Content) — are and will remain the exclusive property of Trackbie and its licensors.

These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Application on your personal device solely for personal, non-commercial purposes. You may not use the Trackbie brand name or logos without our prior express written permission.

7. User Content & License Grant

You retain ownership of all text, photos, voice notes, and data you log in Trackbie ("User Content"). By submitting User Content, you grant Trackbie a worldwide, non-exclusive, royalty-free license to host, store, process, analyze, and display that content solely to provide, personalize, and improve the Service (including sending food entries to authorized third-party AI model providers for nutritional analysis).

We do not sell your User Content to third parties or advertisers.

8. Health, Nutrition, and AI Disclaimer

• Nutritional estimates (calories, macros, TDEE, fiber) generated by our AI models are automated approximations and should not be relied upon as clinical or medical values.
• Always consult a licensed healthcare professional or registered dietitian before starting any major diet, workout, or health program.
• In case of a medical emergency, contact emergency services immediately.

9. Termination & Account Suspension

We reserve the right, in our sole discretion, to suspend or terminate your account and restrict your access to all or part of the Application at any time, with or without prior notice, if:

• You breach or violate any provision of these Terms or our Acceptable Use Policy;
• You engage in fraudulent, illegal, or abusive conduct;
• Your account activity poses a security risk to the Service, Trackbie, or other users;
• Required by law, court order, or regulatory authority.

Upon termination, your right to use the Service immediately ceases, and we may delete your account records in accordance with our retention policy.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

Trackbie expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the app will be uninterrupted, error-free, timely, secure, or free of viruses or other harmful components.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TRACKBIE, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA LOSS, SERVICE INTERRUPTIONS, DEVICE DAMAGE, OR PERSONAL RELIANCE ON AI ESTIMATES.

Our total aggregate liability for any claims arising out of or related to these Terms or your use of the Application shall be limited to the amount paid by you, if any, for accessing the Application during the twelve (12) months preceding the claim, or $50 USD (whichever is lower, or the minimum statutory limit required by applicable law).

12. Third-Party Services & Integrations

The Application relies on trusted third-party services, including Supabase (authentication & backend), PostHog (telemetry & analytics), Expo (mobile infrastructure), and AI model providers (OpenAI, Anthropic, Google Vertex AI). We do not control and are not responsible for the availability, terms, or privacy practices of such third parties.

13. Indemnification

You agree to defend, indemnify, and hold harmless Trackbie and its officers, directors, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of your violation of these Terms, your misuse of the Service, or your User Content.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the competent courts of India, subject to applicable local consumer protection laws.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will post the revised Terms with an updated "Last Updated" date. For material changes, we will provide reasonable advance notice via in-app alerts or email.

Your continued use of the Application following the posting of updated Terms constitutes your binding acceptance of the changes.
